Chef on the Block - User Terms of Service

Welcome to Chef on the Block! These Terms of Service ("Terms") are a legal agreement between you and Chef on the Block LLC, a Utah limited liability company ("Chef on the Block," "we," "us," or "our"). These Terms govern your use of our mobile application and website (collectively, the "Platform") as a user purchasing food. By creating an account or placing an order, you agree to these Terms.
1. Our Role as a Marketplace
Chef on the Block operates as a marketplace platform that connects local home chefs with food lovers in their community. We bring the kitchen back to the neighborhood — no restaurants, no delivery chaos, just real people cooking real food near you.
What we do:
- Provide a platform for discovering nearby chefs and their offerings
- Facilitate order placement and payment processing
- Enable communication between buyers and chefs
- Send notifications about orders and chef activity
What we don't do:
- Prepare, cook, or handle any food
- Employ or control the chefs on our platform
- Guarantee the quality, taste, or safety of food prepared by chefs
- Provide delivery services
Chefs on our platform are independent sellers, not employees or agents of Chef on the Block.
2. Eligibility and Your Account
To use Chef on the Block, you must:
- Be at least 18 years old (or the age of majority in your jurisdiction)
- Provide accurate and complete information when creating your account
- Verify a valid phone number via SMS during registration
- Maintain the security of your account credentials
- Keep your account information up to date
Phone Verification Requirement: All users must verify a phone number to create and maintain an account on Chef on the Block. Verification is completed via a one-time SMS code sent to your phone. If you change your phone number, you must re-verify the new number. Accounts without a verified phone number may have limited functionality.
You are responsible for all activity that occurs under your account. If you suspect unauthorized access, please contact us immediately.
3. Ordering and Payment
Placing Orders:
- Orders are placed through the Platform based on real-time availability
- Listings may be time-limited and inventory is first-come, first-served
- Once you confirm an order, you are committing to purchase
Payment:
- Payments are processed through third-party payment processors (such as Stripe)
- You agree to pay the full amount displayed at checkout, including any applicable taxes or fees
- Payment must be completed before your order is confirmed
Pricing:
- Prices are set by individual chefs and may vary
- Chef on the Block is not responsible for pricing errors by chefs
4. Pickup and Fulfillment
Your Responsibilities:
- Arrive at the designated pickup location during the specified pickup window
- Present your pickup code to receive your order
- Verify your order at the time of pickup
Important:
- Orders are for neighborhood pickup only
- Late arrivals may result in food quality changes or order cancellation
- Chefs are not obligated to hold orders beyond the pickup window
5. Refunds and Cancellations
General Policy:
- Once a chef begins preparing your order, refunds are not guaranteed
- Cancellation requests made before food preparation begins may be eligible for a refund
How We Handle Issues:
- Refund requests are reviewed on a case-by-case basis
- Chef on the Block may, at its sole discretion, issue partial or full refunds
- To request a refund, contact us through the app within 24 hours of your order
Non-Refundable Situations:
- Failure to pick up your order during the pickup window
- Taste preferences or personal dissatisfaction
- Orders consumed before reporting an issue
6. Food Safety and Your Health
Important Acknowledgments:
By ordering through Chef on the Block, you understand and agree that:
- Food is prepared by independent home chefs in their personal kitchens
- Home kitchen standards may differ from commercial restaurant standards
- There are inherent risks associated with consuming home-prepared food
- Chef on the Block does not inspect, certify, or guarantee food safety
Your Responsibility:
- Review chef profiles and any available food safety certifications
- Communicate any food allergies or dietary restrictions directly with the chef before ordering
- Make informed decisions about what you choose to consume
Allergies and Dietary Needs:
- It is your sole responsibility to verify ingredients and preparation methods
- Cross-contamination may occur in home kitchen environments
- If you have severe allergies, please exercise appropriate caution
7. Ratings, Reviews, and User Content
Providing Feedback:
- You may rate and review chefs after completing orders
- Ratings must be honest, fair, and based on your actual experience
- Do not submit fake reviews or manipulate ratings
Content Standards:
- All content you submit (reviews, photos, profile information) must be truthful and not misleading
- You may not post content that is obscene, threatening, defamatory, or otherwise objectionable
- Chef on the Block may review, moderate, or remove content that violates these standards
- We use automated and manual content moderation to maintain platform safety
Content License:
- By posting content on the Platform, you grant Chef on the Block a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the Platform
Expected Conduct:
- Treat chefs and other users with respect
- Do not engage in harassment, abuse, or threatening behavior
- Do not attempt to defraud chefs or the platform
- Do not use the platform for any illegal purposes
- Do not list, sell, or solicit any illegal or prohibited items through the Platform
8. Push Notifications
Chef on the Block may send you push notifications related to:
- Order status updates (confirmation, ready for pickup)
- Messages from chefs about your orders
- New listings from chefs you follow
- Account and security alerts
You can manage your push notification preferences in your device settings or within the app. Essential service notifications (order updates, security alerts) cannot be disabled while you have an active account.
9. Location Services
Chef on the Block uses your device's location to:
- Show you nearby chefs and available food listings
- Display pickup locations and distances
- Improve local search results
Location access is used only while the app is in the foreground. We do not track your location in the background. You can disable location services in your device settings, though some features may be limited without location access.
10. Intellectual Property
Our Property:
- The Chef on the Block name, logo, app design, and all related trademarks, service marks, and branding are the property of Chef on the Block
- The Platform's software, code, features, and functionality are owned by or licensed to Chef on the Block
- You may not copy, modify, distribute, or reverse-engineer any part of the Platform
Your Property:
- You retain ownership of content you create (such as reviews and photos)
- By submitting content, you grant us the license described in Section 7
11. Limitation of Liability
To the fullest extent permitted by law:
- Chef on the Block is not liable for any illness, injury, allergic reaction, or other harm resulting from food purchased through the platform
- Chef on the Block is not responsible for the actions, omissions, or conduct of chefs
- Our total liability for any claims related to your use of the platform is limited to the amount you paid for the specific order in question
- Chef on the Block is not liable for any indirect, incidental, special, consequential, or punitive damages
We provide the platform "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Dispute Resolution
Informal Resolution First:
If you have a dispute with Chef on the Block, you agree to contact us first at support@chefontheblock.com and attempt to resolve the dispute informally for at least 30 days before initiating any formal proceeding.
Binding Arbitration:
If we cannot resolve the dispute informally, you and Chef on the Block agree to resolve any claims relating to these Terms or the Platform through final and binding arbitration, except that either party may bring claims in small claims court if eligible. Arbitration will be conducted under the rules of the American Arbitration Association (AAA).
Class Action Waiver:
You agree to resolve disputes with Chef on the Block on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.
13. Apple App Store Terms
If you downloaded the Chef on the Block app from the Apple App Store, the following additional terms apply:
- These Terms are between you and Chef on the Block, not Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support services for the app.
- In the event of any failure of the app to conform to applicable warranties, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app or your use of the app, including product liability claims, failure to meet legal or regulatory requirements, or consumer protection claims.
- In the event of a third-party intellectual property claim relating to the app, Chef on the Block (not Apple) is responsible for the investigation, defense, settlement, and discharge of such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce them against you as a third-party beneficiary.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.
14. Account Deletion
You may delete your account at any time through the Account Settings page in the app. Account deletion:
- Requires password confirmation for security
- Permanently removes your profile, order history, reviews, and personal data
- Cannot be undone once confirmed
- Some information may be retained for legal, regulatory, or fraud prevention purposes
Upon deletion, any pending orders will be affected. We recommend completing or cancelling any active orders before deleting your account.
15. Account Suspension and Termination
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in fraudulent or abusive behavior
- Harass chefs or other users
- Attempt to circumvent our payment system
- Provide false information
- Post prohibited or illegal content
We reserve the right to refuse service to anyone at our discretion.
16. Changes to These Terms
We may update these Terms from time to time. When we make changes:
- We will post the updated Terms on the platform
- We will update the "Last Updated" date
- For significant changes, we may notify you through the app or via email
Your continued use of Chef on the Block after changes take effect constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the platform will be resolved in accordance with applicable law and the dispute resolution provisions in Section 12.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Chef on the Block regarding your use of the Platform.
